Employee Leave & Pay Rights: Unpacking Fair Work Act Changes 

The Australian Government has recently introduced new laws under the Protecting Worker Entitlements package, leading to significant changes in the Fair Work Act. These changes aim to enhance the rights and protections of workers, particularly in areas such as leave entitlements and public holiday pay. 

What Applies Now 

Several changes took effect on 1 July 2023, including amendments to unpaid parental leave entitlements, protections for migrant workers, and alterations to the interaction between enterprise agreements and workplace determinations. These changes are designed to ensure fair treatment and equal opportunities for all workers, regardless of their background or family circumstances. 

What Applies Later 

Further changes are set to take effect in December 2023 and January 2024. These include changes to authorised employee deductions, the introduction of the right to superannuation in the National Employment Standards, and amendments to long service leave entitlements for casual employees in the black coal mining industry.

In addition to these changes, there are other workplace law amendments starting from June 2023 until the end of the year. These changes will further strengthen the rights and protections of workers, ensuring a fair and equitable workplace for all.
